Website terms

This website is owned and operated by ATLASweb. A register advertising company. This is the user agreement that governs your use of this website and the provision of the services we provide you.

Please take time to read these terms as it is important for both of us that you understand our contractual relationship both relating to your use of our website and the services we provide.

1.) Specific terms relating to the reservation of accommodation

a. Balivillas.cc acts as an advertising agent

When we arrange for accommodation to be reserved on your behalf, Balivillas.cc operates to an agency model. This means that we act as an agent for the disclosed third party accommodation providers, such as the owners of the villas, travel agents, or other suppliers. These terms form the contractual basis of that agency service.

What this agency service also means is that the final contract for your stay within the accommodation will be between you and the accommodation provider and not between you and us. There is a difference between the agency services we provide (which involves helping you find the accommodation you want and introducing you to its provider) and the service delivered by the provider, which is the provision of the accommodation itself.

In most cases there will be additional terms and conditions that will govern the contract for the reservation of the accommodation as each accommodation provider is likely to have bespoke terms and conditions relating to the reservation of their accommodation.

All such additional terms and conditions will be available to you from our website before you complete your transaction. Please make sure that you read these terms and conditions before completing your transaction. These additional terms and conditions will become part of the contract you make with the provider.

As we act as agent this will mean that we have no contractual liability to you in respect of the accommodation. If there is a problem with the accommodation then typically your contractual or statutory remedy will be against the accommodation provider, not us.

b. Booking

Displaying the accommodation on our website is not an offer by us or the accommodation provider to sell availability within that accommodation to you; instead it is an invitation to you to make one availability request to the provider, which you do by submitting an Online Order Form.

A transaction with one of the accommodation providers will be completed in one of two ways:

Villa owners/ reservation managers/travel suppliers can ask just your credit cards details to secure the booking, or a deposit from 10% up to 50% .If you cancel a confirmed booking, different policies apply to each villa. Please read carefully each villa cancellation policy.

They accept Visa, MasterCard, American express and other debit/credit cards on request. Please ensure that the details you give match those on your credit card billing statement. Owners or reservations managers, also reserve the right to cancel a booking if payment is declined or incorrect cardholder details and billing information have been supplied.

d. Bookings

All accommodation providers have their own terms and conditions that will apply to payment of the balance, and cancellation. The accommodation provider may request that you pay all or part of the balance before arrival, on arrival or on departure. You may be contacted directly by the provider to confirm payment terms.

• Booking confirmation

Following a successful booking our providers, will send to you confirmation via e-mail, which will contain a unique booking number.

• Booking amendments

In many cases there will be charges imposed on you by the accommodation providers in the event that you wish to amend your booking. These charges will be in the contract between you and the provider.

• Special requests

When you make special requests that go beyond the services listed on the website we will of course work with the providers to try to ensure that the special request is met. However, special requests cannot be guaranteed, and, unless any liability arises due to us not complying with this term, we cannot be liable if the special request is not met.

• Change of details

It is important that all the information you give us when you contact us or otherwise when you use the website, is correct. This includes, without limit, ensuring that we have your correct contact (including e-mail) details at all times. It is your responsibility to inform us of any changes by contacting us on enquiriesatbalivillas.cc as soon as possible. We cannot be held liable for sending you any relevant information where you have given us incorrect or redundant contact details.

• Minimum age

In order to make a purchase you must be over 18 years old, be purchasing for yourself and have the legal capacity to make the transaction.

• Your details
Please make sure that upon receipt of the confirmation email or other communication from us or the owners, you check them carefully to make sure they accord with our agreement. If they do not, please contact us immediately on enquiriesatbalivillas.cc to highlight your concern. It is your obligation to assist us to mitigate the potential loss caused by any errors by giving us adequate notice of any problem.

3.) General Terms

• While all the information displayed on this website, including, without limit, descriptions of accommodation and attractions, and details of prices and availability, is believed to be accurate by Balivillas.cc the information has been provided to us, by the individual accommodation providers and suppliers. The information is therefore provided without any guarantees, conditions or warranties as to its accuracy. To the extent permitted by law, we and third parties connected to us hereby expressly exclude:

• All conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.

• Any liability for any direct, indirect or consequential loss or damage incurred by any user in connection with our website or in connection with the use, inability to use, or results of the use of our website, any websites linked to it and any materials posted on it, including, without limitation any liability for: loss of income or revenue; loss of business; loss of profits or contracts; loss of anticipated savings; loss of data; loss of goodwill; wasted management or office time; and for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable.

• The Indonesia courts will have exclusive jurisdiction over any claim arising from, or related to, these terms or to a visit to our website although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. These terms of use are governed by laws of Republic Indonesia.

4.) Terms relating to Website Use
